The Rules Of The Lottery

  1. All proceeds from the Conservative Lottery go to National Conservative Draws Society (NCDS), 1 Norfolk Row, LONDON, SE1 7JP (the "Promoter”), which donates all profits to the Conservative Party.
  2. Your purchase of Conservative Lottery entries, inclusive of any Seasonal Superdraw entries, is solely in accordance with the terms and conditions (“Rules”) under which the Promoter from time to time promotes its lotteries.
  3. The Promoter will publish the Rules on the Conservative Lottery website and will notify you by email in the event of any significant changes to these Rules.
  4. The Promoter will comply with the advertising codes of practice issued by the Committee of Advertising Practice (CAP) and the Broadcast Committee of Advertising Practice (BCAP) that apply to the form and media in which it advertises its gambling facilities and will apply the principles included within these codes of practice for media not explicitly covered.
  5. Entry is open to residents of mainland Great Britain and Northern Ireland only. We are not licensed to accept entries from the Channel Islands or the Isle of Man. Licence holders directly involved in the running of the Conservative Lottery are excluded (list of names available on request).
  6. By entering the Conservative Lottery you agree to comply with:
    • These Rules;
    • The Licence Conditions and Codes of Practice (LCCPs) issued from time to time by the Gambling Commission under legislation laid down in the Gambling Act 2005; and
    • Any further instructions or Rules which may be issued from time to time by the Promoter.
  7. You represent and agree that:
    • You are 18 years of age or over;
    • You will not buy or purport to buy an entry to the Conservative Lottery on behalf of anybody under the age of 18; and
    • You will provide accurate entry information, including your name, postal address, email address and telephone number and accept that it is your responsibility to keep us informed of any changes to your contact details as soon as they arise.
  8. You agree that you shall not be entitled to receive any prize if you are unable to substantiate to the Promoter your representations under paragraphs 7 (a), (b) and (c) above.
  9. You accept that the Conservative Lottery is licensed and regulated in Great Britain by the Gambling Commission (www.gamblingcommission.gov.uk) and that in certain circumstances the Promoter may be unable to provide refunds or replacements once you have purchased your Conservative Lottery entries.
  10. The prizes for the Conservative Lottery are printed on the marketing and promotional materials provided and are advertised on the Conservative Lottery website. There are no alternatives to any prize and no interest is payable. Prizes will be paid by cheque and posted to the winners within 7 days of any Conservative Lottery draws being completed. Entrants will be notified as to any change in the prize structure via the Conservative Lottery website.
  11. The cost of each entry is £1. More than one entry can be purchased and payment must be made in advance by one of the methods permitted. Monthly Direct Debit payments of £5 per entry will ensure that you never miss a Conservative Lottery draw and any excess pence that don't play in a draw will be donated to the Conservative Party. All payments received other than those gratefully accepted as donations will be committed to individual Conservative Lottery draws and treated as Lottery proceeds.
  12. The Promoter reserves the right to:
    • Decline to accept an application;
    • Cancel an existing subscription;
    • Award any prize to an alternative winner if the Promoter has grounds to believe that you have breached any of these terms and conditions, acted fraudulently or illegally, or on other reasonable grounds, and the Promoter shall have no liability to you for any loss or damage you suffer arising from the Promoter exercising such rights.
  13. The Promoter may (without giving any reason or notice), terminate, suspend or modify the Conservative Lottery scheme.
  14. Any cancellation of an existing subscription will not affect your prior purchase of Conservative Lottery entries nor your rights as a holder of such entries, providing that you have complied with any applicable Rules in respect of such entries.
  15. The Promoter will conduct the Conservative Lottery draw every Friday. The draw will be made using a Random Number Generator (RNG) that has been tested and approved by an independent, Gambling Commission approved, third-party test house.
  16. The winning numbers will be published on the Conservative Lottery website and will be available upon request by telephoning the Conservative Lottery helpline from the following working day (telephone 01524 753265, from Monday-Friday between 9am – 5pm, excluding public holidays).
  17. No liability is accepted for the loss, theft or delayed receipt of any communication.
  18. Nothing in these terms and conditions shall limit the Promoter’s liability for death or personal injury caused by its negligence, fraud or for any other matter for which liability may not be limited by law.
  19. The Promoter is not liable to you for:
    • Loss or damage suffered by you, including the right to receive a prize, if you have not complied with these Rules, the Gambling Commission’s LCCPs and any relevant participation instructions which may be issued from time to time, by the Promoter;
    • The Promoter’s failure or inability to contact you and/or award any prize due to any errors, omissions or inaccuracies in the entry information you have provided, or your failure to update these if they change;
    • Loss or damage incurred by you in connection with or arising from your participation in the Conservative Lottery;
    • Any delays or failures in the Conservative Lottery website or any software, hardware or any other systems used by the Promoter for the administration of the Conservative Lottery; and
    • Any failure or delay beyond the Promoter’s reasonable control.
  20. The Promoter is not liable to you in contract, tort (including but not limited to negligence) or otherwise in connection with the Conservative Lottery for loss of venue, contract, profits, anticipated savings or loss of data, any special or indirect or consequential losses, or any loss of goodwill or reputation.
  21. The Promoter is not liable for any lost, stolen, delayed, incomplete or illegible entries, or entries that reach us after the closing date, or for any delay in bank payments. Proof of posting is not proof of delivery.
  22. All warranties, conditions or guarantees relating to the Conservative Lottery made by or on behalf of the Promoter whether express or implied by law in the course of dealings or otherwise, are excluded to the maximum extent permitted by law.
  23. The Promoter’s liability to you shall be limited to the amount of any prize which has become due to you.
  24. If you choose not to continue playing, you may cancel at any time by notifying the Promoter by post, email or by telephone. Any subscriptions you may have paid in advance will continue to play in the Conservative Lottery until your credit expires, unless you specifically request a refund. Any remaining advance payments under £1 will be treated as a donation to the Conservative Party. If you subscribe by Standing Order, it is your responsibility to cancel this payment with your bank/building society.
  25. You may be asked for a quote and photograph for marketing purposes.
  26. The Promoter reserves the right to use winner’s names for promotional purposes. These will only be used in summary e.g. Mr S from Guildford.
  27. Cash prizes will be automatically paid out to the winners by postal cheque, using the contact details provided. There is no need to contact the Promoter to claim a prize.
  28. You must cash any cheques within six months of receipt. Any uncashed winners cheques will be assumed to be a donation to the Conservative Party if they remain uncashed after six months.
  29. The Promoter operates a Complaints And Disputes Procedure which is available via the Conservative Lottery website, or upon request by telephoning the Conservative Lottery helpline (telephone 01524 753265, from Monday-Friday between 9am – 5pm, excluding public holidays).
  30. The Conservative Lottery will keep your data secure. We will never sell your personal data and will not share it with other organisations unless it is necessary to provide you with information or a service that you have requested from us. We may use your information to contact you in the future about Conservative Lottery activities, including fundraising. If you would prefer not to receive communications from us, please let us know by contacting the Lottery Helpline (telephone 01524 753265, from Monday-Friday between 9am – 5pm, excluding public holidays).
  31. National Conservative Draws Society is committed to ensure that information about how to gamble responsibly and how to access information and help in respect of problem gambling is readily available to all.   32. These terms and conditions shall be governed by English law and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
